From December 15, 2009 to February 6, 2010, VinaTouch will have a raffle program called “LUCKY TICKET” to show our
appreciation to our customers. Customers who make purchases during this period
will be entered into our drawing automatically.
The first prize is TWO (2) FIRST CLASS round-trip tickets to Vietnam.
Additionally, customers can win other valuable prizes such as APPLE IPHONE 3G
and minutes to call Vietnam (100 Prize).
The more you spend, the more tickets you will receive, the more chances to win.
Don’t wait to build your chance to be our winners. The raffle will be
terminated on February 6th, 2010, and the winners will be announced on our
website on February 7th, 2010.
1. Promotion Period:
VinaTouch Raffle starts on 12/15/2009 and ends on 2/6/2010.
2. Who can participate in the Raffle?
Any new or existing customers who purchase long distance services.
3. How to participate?
A minimum single purchase of $20 will be given automatically one Electronic
Raffle ticket. Customers will receive the tickets as follows:

4. Prize:
1st prize: 2 FIRST CLASS round-trip tickets to Vietnam
2nd prize: Apple iPhone 3G
3rd prize: 5000 minutes calling Vietnam
4th prize (100 prizes): 1000 minutes calling Vietnam
OFFICE RULES, TERMS AND CONDITIONS:
1. By entering, participants agree to be bound by these Official Rules, Terms and Conditions and the decisions of VinaTouch, (the “Company”), which shall be final.
2. Entry to the Raffle is available only to individuals over the age of 18. You may be asked to provide proof of age and /or identity.
3. Employees of the Company will not be eligible to enter the Raffle.
4. The Raffle period is from December 15th, 2009 to February 6th, 2010. Entries received prior to or after the Raffle period will not be accepted.
5. Prizes are non-transferable and cannot be exchanged or redeemed for cash.
6. Except where prohibited by law, acceptance of any prize constitutes permission for the Company to use the winner's names, photographs, likenesses, voices, addresses (only city and state), and testimonials, in print, broadcast, or new media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other raffle and/or promotion sponsored by them without further compensation.
7. The Company reserves the right to alter any rules, terms and conditions of the Raffle in any way at any time without prior notice.
8. The Company reserves the right, at any time, to cancel, modify or suspend the Raffle if, in its sole judgment, the Raffle is not capable of being conducted as specified without prior notice.
9. Electronic raffle number entries will be randomly assigned to eligible individuals who must be an existing customer and in good standing at the time of the promotion and throughout the redemption period. Good standing account is an account that customers continually recharge and make calls in the last 3 months.
10. Prizes not redeemed or claimed within the 90-day period will automatically be forfeited.
11. If the winner is the account having more than one phone number, the phone number that has been used the most in the last 3 months will be the winner.
12. The Company will not be involved in any kinds of customers’ dispute between the person making payment for the account and the person making call in the account.
13. Balance transfer from one account to another or payment refund will result in withdrawing numbers of ticket that are issued relevant to the payment.
14. Promotion cannot be combined.
15. The Company may, at its sole discretion and without consultation or reference to Lucky Ticket participants, at any time substitute or replace any prize with any other prizes of equal or similar value at the choice of The Company.
16. The winners will be solely responsible for any additional cost applicable to the Prizes including any taxes and fees on the Prize or associated with the delivery, receipt or use of the Prize.
17. Winners will be selected by random drawing from among all eligible entries received. Random drawings will be held under the supervision of the Company.
18. All decisions by the Company are final and binding.
19. Winners will be notified by e-mail, telephone or mail, which notification will be determined in the sole discretion of the Company.
20. Each winner may be required to provide the Company with proof that he or she is the authorized account holder associated with the winning entry.
21. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to return a completed and executed affidavit and release as required, an alternate winner may be selected.
22. All federal, state, and local laws apply.
23. The Company and its employees, officers, directors, shareholders, agents, and representatives and their parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Raffle of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of the Company that may cause the Raffle to be disrupted or corrupted; (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Raffle; or (vi) any printing or typographical errors in any materials associated with the Raffle.
24. The Raffle shall be construed and governed by, and any and all actions or claims in any way related to this Raffle are subject to, the federal laws and regulations of the United States, the state laws and regulations of the State of California, and local laws and regulations of the County of Orange, California.
25. Any and all actions or claims in any way related to this Raffle shall be filed in the courts of the State of California, County of Orange. By Providing an Entry to this Raffle, you submit to the jurisdiction of the courts of the State of California in the United States for any and all actions or claims in any way related to this Raffle, and expressly agree that such actions or claims are subject to the federal laws and regulations of the United States, the state laws and regulations of the State of California, and local laws and regulations of the County of Orange, California.
26. The Company may prohibit you from participating in the Raffle, if at the sole discretion of the Company, you repeatedly show a disregard for the Raffle Official Rules, Terms and Conditions, or act (1) in an unsportsmanlike manner; (2) with an intent to annoy, abuse, threaten, or harass any other player or a representative of the Company; or (3) in any other disruptive manner.
27. By participating, entrants agree that the Company, those involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Raffle, including entry and participation in this Raffle and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to a participant's entry or participation in this Raffle, they will indemnify the Company from any and all such claims, including the attorneys' fees related thereto. The Company shall not be liable for entries and winner notification responses that are delayed, lost, misdirected, mis-delivered, marked postage-due, illegible, mutilated, incorrect or incomplete, and such entries will be not be eligible for this Raffle. Any person attempting to defraud or in any way tamper with this Raffle will be ineligible for prizes and may be prosecuted to the full extent of the law.
28. If there is any conflict between the English and Vietnamese version of the Raffle Rules, Terms and Conditions, the English version shall govern.
29. For an Official Winners List or a copy of these Official Rules, Terms and Conditions, send a self-addressed, stamped envelope (WA and VT residents need not affix postage) Raffle, c/o VinaTouch, 9039 Bolsa Ave., Suite 211, Westminster, CA 92683. Replies will be sent after the completion of the Raffle. Winners List requests must be received within six (6) months of completion of the Raffle.
